Greg Dent charged with sexual assault: FSU receiver to be suspended indefinitely

Florida State senior wide receiver Greg Dent was arrested Sunday on a charge of sexual assault under Florida Statute 794.011 (5).

The statute reads:

A person who commits sexual battery upon a person 12 years of age or older, without that person's consent, and in the process thereof does not use physical force and violence likely to cause serious personal injury commits a felony of the second degree...

Here are pertinent details from the arrest/probable cause affidavit. All of this is alleged. This is very difficult to read.

Please note that the probable cause affidavit, which is written by the police to convince a magistrate that there is probable cause to issue a warrant for the arrest of the suspect Dent for the listed charges. He is innocent until proven guilty, and plenty of cases look bad based on the warrant, but look a lot different when all of the facts come out.

  • The incident is alleged to have occurred around 3:30 a.m. on June 9.
  • The victim alleges that she is "very good friends" with Dent, and has been so since their first freshman year of high school.
  • The victim alleges that she went to a night club with Dent, his roommate, and another friend. After, they went to McDonalds before heading back to Dent's apartment.
  • The victim alleges that she has stayed at Dent's apartment before without incident. She planned to do so on the night in question as well. The victim claims that Dent was laying with his head at the top of the mattress, and she with her head at the bottom, facing opposite directions.
  • The victim alleges that she awoke with Dent attempting to kiss her on the lips, told Dent "no," and tried to return to sleep. This is alleged to have happened repeatedly. The victim claims that after increasingly forceful attempts from Dent to kiss and touch her, she bit Dent on his top lip. The victim believed Dent had "gotten the message that she did not want him to kiss or touch her."
  • It is alleged that soon after, Dent returned to the bed completely naked, got into bed, and laid the same direction. It is alleged that Dent became very aggressive, pulled off the victim's shorts and underwear as she struggled and told him "No! Get off! Let me go!," while Dent is alleged to have continued to try to forcefully have sex with the victim.
  • The victim alleges that she pulled Dent's hair with one hand and punched him in the head with the other. The victim also claims to have kicked Dent and hit him with her elbow. Despite her efforts, Dent is alleged to have [partially overcome her resistance] twice, before the pair allegedly fell to the floor, where the struggle continued.
  • Once on the floor, the victim claims to have made it to her feet, grabbed her clothes, ran out the door yelling at Dent, and dressed outside. She later reported the incident. The time of reporting is not listed.
  • Dent is alleged to have given a statement to police after being read his Miranda rights (AKA "the right to remain silent"), but the statement is redacted in the report, under FL 119.071(2)(e).

Dent made his first appearance Monday and his bond was set at $15,000. As part of his pre-trial release, he is to have no contact with the alleged victim.

Florida State's policy is to suspend any student athlete charged with a felony until the case has been adjudicated. An announcement is expected later today.

All suspects are presumed innocent until proven guilty.

In 2012, Dent had 27 catches, 355 receiving yards and two touchdowns. He started four games, and was expected to have an expanded role in 2013.

Out of respect for both the alleged victim and for Dent, who has not been convicted, please avoid wild speculation in the comments section.
